emergency physicians. The bill passed the Health 
Committee as amended on a bipartisan 17-9 vote 
and is now before the full House for consideration. 
The Hospital and Healthsystem Association of 
Pennsylvania (HAP), a significant lobbying force in 
Harrisburg, opposes the bill. At PACEP’s request, 
the bill is on hold in the House as our advocacy 
team works to overcome HAP’s objections. PACEP 
leaders and the B&B Team continue to advocate 
for House passage of the bill.

AI in Healthcare 
HB 1925 PN 3349, sponsored by former PACEP 
President and current State Representative Arvind 
Venkat (D, Allegheny), seeks to regulate the use of 
artificial intelligence (AI) in healthcare facilities, by 
insurance companies, and in MA/CHIP managed 
care plans. The bill mandates disclosures to 
patients and covered individuals regarding AI 
use in clinical decision-making and utilization 
review processes. HB 1925 sets responsible use 
standards for AI algorithms, including non-
discrimination and periodic review, and requires 
annual compliance statements. The bill also 
outlines enforcement mechanisms, penalties for 
violations, and establishes oversight by relevant 
departments. PACEP’s recommendations were 
incorporated into Representative Venkat’s draft 
legislation, thus only patient-facing AI generated 
content will need to be disclosed by a provider 
to a patient. Disclosure of AI use is not required 
when information has been individually read and 
reviewed by a human healthcare provider. PACEP 
Immediate Past President Dr. Elizabeth Werley 
testified before the House Communications and 
Technology Committee on December 15.
On May 5, HB 1925 was amended by the House 
Communications and Technology Committee. 
PACEP leadership agreed to this amendment 
that provided more clarity to defined terms such 
as high impact artificial intelligence and static 
decision support tools. In addition, a physician’s 
employer cannot punish a physician for using 
independent medical judgment.

with a unanimous 203-0 vote on October 27,
