The bill mandates disclosures to patients and covered individuals regarding AI use in clinical decision-making and utilization review processes. HB 1925 sets responsible use standards for AI algorithms, including non- discrimination and periodic review, and requires annual compliance statements. The bill also outlines enforcement mechanisms, penalties for violations, and establishes oversight by relevant departments. PACEP’s recommendations were incorporated into Representative Venkat’s draft legislation, thus only patient-facing AI generated content will need to be disclosed by a provider to a patient. Disclosure of AI use is not required when information has been individually read and reviewed by a human healthcare provider. PACEP Immediate Past President Dr. Elizabeth Werley testified before the House Communications and Technology Committee on December 15.
